Iowa Personal Injury Accidents and those Pesky Cell Phones
CELL PHONE, DISTRACTED DRIVER, OVER THE CENTERLINE, SERIOUS INJURY OR DEATH
I have been at this for quite a while, like well over 30 years. Nothing much has changed accept speed truck weights along with numbers of vehicles. And then there are those cell phones. Yeah, cell phones. They are a blessing and curse. They are the leading indicator of whether someone will likely have an accident. I read all the Iowa Department of Public Safety minimal crash reports. Yup, every one. The batch printed on March 1, 2024 had quite a few fatalities and quite a few vehicles crossing the center line.
Now, why might a car or a truck cross the center line? Could be weather related. Yeah, maybe. But, far more often it has to do with the driver using his or her cell phone. When a car crosses the center line and hits an oncoming car or truck head-on, that cell phone can be a telling piece of information. We lawyers call it evidence. It is a finger print that does not go away with the wipe of a cloth. What Iowans need to know is what to do and quickly to do it following a serious accident.
BE AWARE, STAY OFF THE PHONE
Now, I am not talking about a small and insignificant fender-bender. I am talking about an accident resulting in serious injuries or death. Broken bones, death, loss of limb, brain damage, spinal cord injuries, something resulting in surgery and hospitalization. Or, a trip to the morgue.

A person shall not use a hand-held electronic communication device to write, send, or view an electronic message while driving a motor vehicle unless the motor vehicle is at a complete stop off the traveled portion of the roadway. Dec 22, 2023
