Before you enter a roadway from a side road or a stop sign, you first have to yield to oncoming traffic that has the right of way. [ROW] If you do not then you can cause an accident and if you do, you’re going to get a ticket for improper driving.
In this instance, according to the news report, the younger driver pulled out onto 230th Street (County Road C-44) and caused Malea Brown to have to drive off the roadway in order to avoid a more serious crash. Unfortunately, she drove into a tree and had to be taken away by ambulance.
This is what can be characterized as a failure to yield, failure to drive using due care, failure to maintain a proper lookout and may also be distracted driving. However, you characterize pulling out prematurely from a stop sign or onto the main road, you are generally the at-fault driver. And in Iowa, at-fault is meaningful when it comes to who’s insurance company ends up paying.
