Drunk Driving is a Dram Shop Action
Whenever someone driving a car is under the influence of alcohol and causes an accident, the possibility of a dram shop lawsuit is likely. The Iowa State Patrol reported on an accident that took place on January 27, 2023 at the intersection of Highway 71 and 600th Street, in Buena Vista County, Iowa.
How did the accident happen?
According to the ISP a GMC was eastbound on 600th Street, approached the stop sign at the intersection of Highway 71, failed to yield to an oncoming Chevrolet Silverado driven by Michael Sly and a collision ensued.
How badly were people hurt?
Krummen went to Mercy Hospital in Sioux City, Iowa. Not indication about Sly.
Raccoon Valley Radio, Storm Lake Radio, the Storm Lake Times Pilot and KSCJ all reported on this collision.

Here is something you can learn from this type of accident. If any driver in an accident is under the influence of alcohol and over the legal limit, then if they were both sold and served alcohol at a bar or tavern, then those injured may have a claim.

What’s important about knowing this fact?
Iowa’s dram shop laws are under Iowa Code section 123.93. You really don’t need to know the statute section, but you should know the bar has to be put on notice of the potential claim, within six months of the accident. This is especially important if the injured no-fault party dies in the accident. An estate will need to be opened, an executor or administrator appointed, and they will need to provide the bar with notice. Usually via a lawyer who assists the estate with recovery.
