Crossing the Center Line of Median, Never Easily Excused
lombardilaw2022-02-21T09:29:02-07:00
In today’s blog we have several Iowa car accidents from six Iowa Counties that includes Buchanan, Humboldt, Cedar, Delaware, Osceola (in my neck of the woods) and Sioux. Interesting cases with not enough information to really understand the causes of who did or didn’t do what and why.
To know if you have a case more investigation is required.
When considering the rules of the road, I will say this about several of these cases. Crossing the center line or the median is never easily explained especially if your cell phone provider’s bill shows you were on the phone texting at the time of the collision. That kind of usage presumes distracted driving, a violation of the law.
If toxicology reports show alcohol in a driver’s blood, that too creates a presumption against that driver. And if the toxicology report indicates cannabis, with it being illegal in any amount in Iowa, that is also sort of a red flag. We make no judgement as to the general use of cannabis because of it being legal in many states.
If alcohol is involved with the cause, then it is beneficial to you to immediately seek legal help in order to determine if a bar or tavern is involved in selling and supplying the drinks in order to secure an additional source of liability insurance.
If anyone needs assistance, we are available to discuss whether we believe you have a case or at least one to pursue the investigation. These are free consultations. Make sure if you contact me to have the date of the accident and in which county the crash occurred. I have never developed the skill of guessing. If we hear from you terrific, if not stay safe.
If we can help call 1-515-222-1110 or email me at sdlombardi@aol. [Yeah, I’m not getting rid of AOL!]
