So, why do we sometimes pass?

We often pass because we know the time and expense for both our firm and our clients will not be worth the time and effort required. Economic feasibility is what I call it. Sometimes there is a case, but the recovery will not justify our being involved. We do not want to waste your time by engaging in litigation that will not put money into your pockets. And that’s not the only reason.

There are several things every case must have, including good liability, sufficient damages to justify the litigation expense along with the time required to put the case together and then last, insurance coverage. These are the requirements for this three-legged stool to stay upright. If you are missing any one, the case has no legs. Two gone and your case really has no legs.

Some cases we find ourselves telling the potential client they might as well stop calling around to lawyers, because no one is going to take their case, because there isn’t a case. We are not being mean; we are being honest. And that is what we offer, an honest opinion.

I have no idea why lawyers fear telling people the honest reasons behind them declining the case. I do not shy away from just being frank and saying it like it is. I think people would rather be told the truth, even when it isn’t what they want to hear.
