West Des Moines Personal Injury Accidents for April 13, 2022
Today let us cover a few fatal accidents in Iowa, mostly central Iowa. I will not cover deaths by gun violence that is intentional. Those are not “accidents” per se. And for insurance purposes if you point a gun at someone and pull the trigger most insurance policies will not provide coverage.
Boone County, Iowa
Boone County Construction Fatality – A 57-year-old man appears to have been walking around and behind an excavator and was struck by the excavator. The excavator operator was backing and turning the excavator when it happened. The victim died at the scene from his injuries. The location of the accident appears to have been Pickett’s Salvage in Paton, Iowa at 10:54 AM on April 11, 2022. Pickett’s is northeast of Boone, Iowa. This is reported by KCCI.

So, what is this one about as far as personal injury law? With the facts reported, it is difficult to say much about who is at fault or what the potential claim is about. The guy walking around may be a co-workers, in which case, he is eligible for benefits from the employer’s workers’ compensation insurance policy. If he was married, or has dependents, then they are entitled to weekly indemnity benefits. The guy who died would get limited funeral and burial benefits. Since July 1, 2017 when the Republican controlled Iowa Legislature all but destroyed worker rights, those benefits are very limited. And if he was single then the compensation, he is eligible for is nothing to write home about. On the other hand, if the man was a customer, his estate or his spouse and dependents may be entitled to a lot more compensation. He may have been partially at fault. The operator of the excavator may have been at fault. The yard supervisor at Pickett’s may have been at fault. Or, no one may have been at fault. Hard to know because the facts given are few and far between. To really understand what legal causes of action exist, the lawyer must first know why the man was walking around in the salvage yard. From there we can craft what legal options the widow and children have available to them.

Dallas County, Iowa
Dallas County on April 9, 2022 – This is an intersection collision at Highway 141 and Highway P46 at 9:11 PM. We have two vehicles. The first is the Beller vehicle going south on P46 approaches a stop sign, which makes it a controlled intersection with Highway 141, the driver appears to have not stopped at the stop sign, pulled out and collided with Don Motz’s car. Motz is heading east and the two collided on Highway 141. Unfortunately, Motz was fatally injured. There was a passenger in the Motz car. The driver of the Beller vehicle and the passenger of the Motz vehicle were both transported to Iowa Methodist Medical Center. The likely cause of action is against the driver who doesn’t stop and yield the right of way to oncoming traffic. In this instance Don Motz is that the driver with the apparent right of way.
This Dallas County accident seems pretty straightforward. Right of way, yield, failure to yield, look out, speed and driving with due care. We regularly settle this kind of case for limits with all of the available auto insurers. Recently we were asked to get involved with a similar pedestrian death accident and settled it for a half million dollars. Another option could be suing a bar, if the driver had been drinking.
Warren County, Iowa
Warren County on April 8, 2022 – In this one-vehicle collision the Vandeliune vehicle heading south on S23 out of Milo, according the ISP report lost control, slid into the west ditch, rolled several times, tossing out the unbelted occupants who then both died. There was a driver and one passenger. Both were 19-year-old young men.
This is an interesting case, but may not be as easy as it may first appear. A solid investigation would need to be done. That probably is going to involve a private investigator. What I am telling you is a lawyer needs to get involved pronto. And not just any lawyer. You need an experienced personal injury lawyer who knows what they are doing. There may be nothing or there may be something. Just don’t delay.
